The decision of the mediator is not binding on the parties. However, the parties will attempt to obey the decision in good faith.
11.2 Stage 2: Arbitration. In the event mediation does not yield a result suitable or preferred by any one of the parties, arbitration shall follow, the award of which is binding on both parties. The Arbitration shall be done by a sole Arbitrator appointed by Artivatic. The award as the outcome of the arbitration is final and binding on both parties and there shall be no further remedy available to both parties. The arbitration proceedings will take place in the English Language and will be situated in the state of Karnataka.
In the event of the dispute resolution mechanism failing, the matter shall be subject to Indian laws in the jurisdiction of the courts of Bangalore, Karnataka.

Physical Data Security
Our datacentres are hosted on AWS & Google Cloud which are in some of the most secure facilities available today in locations that are protected from physical and logical attacks as well as from natural disasters such as earthquakes, fires, floods, etc. Our in-house data centres are also directly connected to most secure clouds as AWS & Google.
7x24x365 Security. The data centers that host your data (On AWS & Google Cloud) are guarded seven days a week, 24 hours a day, each and every day of the year by private security guards
Video Monitoring. Each data center is monitored 7x24x365 with night vision cameras (AWS & Google Cloud)
Controlled Entrance.Access to the Artivatic data centers (on AWS & Google Cloud) is tightly restricted to a small group of pre-authorized personnel art Artivatic Office secured with multi-level access process.
Biometric, two-Factor Authentication. Two forms of authentication, including a biometric one, must be used together at the same time to enter a Artivatic data center (on AWS & Google Cloud)

Secure Communication. All data transmission to Artivatic Products and services are encrypted using TLS 1.2 protocols, and we use certificates issued by SHA 256 based CA ensuring that our users have a secure connection from their browsers to our service. We use the latest and strong ciphers like AES_CBC/AES_GCM 256 bit/128 bit keys for encryption, SHA2 for message authentication and ECDHE_RSA as the key exchange mechanism.
IDS/IPS. Our network is gated and screened by highly powerful and certified Intrusion Detection / Intrusion Prevention Systems.
Control and Audit.All accesses are controlled and also audited.
Secured / Sliced Down OS. Artivatic’s models, algorithms, and applications run inside a secured, sliced-down operating system engineered for security that minimizes vulnerabilities.
Virus Scanning. Traffic coming into Artivatic (on AWS & Google Cloud) Servers is automatically scanned for harmful viruses using state of the art virus scanning protocols which are updated regularly.
Designing and running cloud infrastructure requires not just technology, but a disciplined approach to processes. This includes policies about escalation, management, knowledge sharing, risk, as well as the day to day operations. Artivatic’s security team has years of experience in designing and operating cloud servers and continually improves our processes over time. Artivatic has developed a world class practices for managing security and data protection risk.
Select Employees.Only employees with the highest clearance have access to our cloud data. Certain authorized Employee access is logged and passwords are strictly regulated. We limit access to customer and business data to only a select few of these employees who need such access to provide support and troubleshooting on our customers’ behalf.

That means a server can fail without a noticeable impact on the system or our services. In fact, on any given week, multiple servers fail without our customers ever noticing it. The system has been designed knowing that server will eventually fail – we have implemented our infrastructure to account for that in line to distributed cloud systems too.
Power Redundancy. Artivatic is hosted on cloud so there are no chances of power off for any of its services and solutions. The office also has power backups to sustain the local servers.
Internet Redundancy. Artivatic is connected to the world –and you- through multiple Tier-1 ISPs. So, if any one fails or experiences a delay, you can still reliably get to your applications and information.
Redundant Network Devices. Artivatic runs on redundant network devices (switches, routers, security gateways) to avoid any single point of failure at any level on the internal network.
Data Protection & Back-up. All kinds of data are backed-up periodically across multiple servers over cloud helping protect the data in the event of hardware failure or disaster.
Security: The system is protected against unauthorized access (both physical and logical).
Availability: The system is available for operation and use as committed or agreed.
Processing Integrity: System processing is complete, accurate, timely, and authorized.

At Artivatic we strive to create quality technology software that you enjoy using for your business or developer life. You have a number of choices to build your models and algorithms on top of available public platforms but we appreciate you giving Artivatic an opportunity to try unique and intelligent end to end products and solutions for your businesses. Thank You. We have created this policy that details what we will do to meet your expectations.
Artivatic has pre-subscription model as well where anyone can subscribe for APIs based model. In this case once you buy the APIs these APIs can be used for lifetime. There will no refund for pre-bought APIs and neither can be transferred or authorized to any third party.
Pay as You Go Model.
This provides flexibility to use the products, modules and solutions as per the usages plan by your business. You can use the APIs as per your usages. The APIs can be bought before use and it is for lifetime. In case your APIs are consumed, you can buy again and start using the service. The service will not be interrupted for 1 week duration after exhausting APIs. There will not be any cancellation of pre-paid APIs (Bought through self service platform). The APIs if not used for certain period can be utilized for lifetime. You can transfer or assign these APIs or Services to anybody else.
Monthly Subscriptions. If at anytime during your first month using our service you are dissatisfied, please contact us. We will do our best to address your issue, provide a work around or give a timeline for a solution that will meet your needs. If you are not satisfied, we will gladly offer you a FULL REFUND for your purchase, and downgrade your account to the free plan for that service. To cancel this, send us email 1 month in advance before withdrawing the service.
Annual Subscriptions. Artivatic doesn’t force you into an annual subscription as a condition to use our services. We prefer to give you the flexibility to choose. In exchange for you signing up for an annual up-front commitment, we offer you a significant discount over the already-low monthly subscription cost. If at anytime during your first 45 days using our service you are dissatisfied, please contact us. We will do our best to address your issue, provide a work around or give a timeline for a solution that will meet your needs. If you are not satisfied, we will gladly offer you a FULL REFUND for your purchase, and downgrade your account to the free plan.
We want you to be happy with our service throughout your entire contract, not only the first 30 days (in case of monthly subscription) and the first 45 days (in case of annual subscription). So we go beyond that. If at anytime during your contract we remove, break or discontinue functionality that was available at the time you signed up for your contract, we ask you to notify us immediately. If we fail to address it on a timely manner to your entire satisfaction, we will offer you a PRO-RATED REFUND for the reminder of your contract.
Auto-Renewal.For your convenience, your monthly and yearly subscriptions will auto-renew until you cancel the service. Every time before your subscription auto-renews, we will send a mail specifying the amount that will be charged to your credit card. Similarly, after each renewal we will send you a receipt via e-mail specifying the amount that has been deducted together with the next renewal date and the next renewal amount. We know that sometimes customers forget to cancel an account they no longer want until it is has already been charged. That’s why you can cancel your monthly/annual subscription even five business days after your renewal date, and we will still process your cancellation and give you a FULL REFUND.
